The Great DUMBO Drop: 2017 Terms & Conditons
No purchase is necessary to enter or win; open to legal residents of the United States. Void in Puerto Rico and where prohibited by law.
A minimum donation of $20 per elephant is requested ($100 for six). Free entries defeat the charitable fundraising purpose of this event and are discouraged. Any person may request one free entry by submitting a written request for such entry to email@example.com prior to 12:00 pm (EST) on Wednesday September 27, 2017.
Odds of winning depend on the total number of qualified entries. A minimum of 1,000 elephants will be dropped on Washington Street. Each elephant which is “adopted” by an eligible individual is entered to win any one of the prizes offered. Any and all taxes on prizes or winnings are the sole responsibility of the winner.
All potential winners are subject to verification of eligibility by The DUMBO Improvement District and of compliance with the promotion rules, including any required documentation, before receipt of the prize. Positive identification and a completed IRS Form W-9 will be required to claim all prizes. For any winners under the age of 18, a parent or guardian must claim the prize.
Elephants must be adopted no later than 12:00 pm (EST), Thursday, September 28, 2017. Entries may be completed online, or in person.
Once the elephants are launched, no attempt to interfere with any elephant is permitted, unless deemed necessary by the event judge. Qualified winning elephants will be selected until all prizes are awarded. In case of bad weather or unforeseen circumstances which prevent launching the elephants, elephants may be selected randomly using any method dictated by the event judge and winners notified by telephone or email.
By participating, participants agree to release, discharge, indemnify and hold harmless The DUMBO District Management Association, and each of its respective officers, directors, employees, representatives, agents, advertising and promotional agencies from and against any claims made by winners, entrants, or any other third parties, related in any way to the operation of this contest as well as any other claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any contest-related activity or participation in this contest.
The winning elephant entries will be posted at the conclusion of the event. Winners need not be present at the event. Winners’ names will be posted on this website. All prizes must be claimed from The DUMBO District Management Association by 5:00 pm (EST) on Friday, October 20, 2017. If a winner does not claim any prize, The DUMBO District Management Association will select an alternate winner through a random drawing of adoption forms.
Acceptance of a prize constitutes permission for The DUMBO District Management Association and its agencies to use winner’s name and/or likeness for advertising and promotional purposes without additional compensation, unless prohibited by law.
All decisions and interpretation as to the rules and regulations will be made by the event judge and his/her judgment is final. The DUMBO District Management Association is not responsible for any typographical or other error in the printing of the offer, administration of the contest or in the announcement of the prize. All federal, state and local laws and regulations apply.
Participant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the New York Easter District Court or the appropriate New York State Court located in Kings County, New York; (ii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest but in no event attorneys’ fees; and (iii) under no circumstances will a participant be permitted to obtain awards for and participant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above may not apply. Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Kings County, shall be construed and governed by the laws of the state of New York, without regard to conflicts of law rules.
